Woodstock Planning Board Meeting 8.8.10

Meeting called to order: 6:30 PM by Bonnie Ham (Chair)

Minutes of previous meeting:
Motion to accept meeting minutes dated 7/12/10 was made by Mike and 2nd by Gil. Roll call vote was taken and all Board members in attendance accepted minutes as written with no corrections. Approved minutes filed.
Reading of communications directed to the Board
1. North Country Council (NCC) 8/25/10 quarterly meeting Topic to be discussed Wind farms, large and small. Bonnie will attend and bring information back to the Board.
Report of officers and committees
Selectmen report GPS work continues locating sewer lines, hydrants, etc.

2. Amending Subdivision regulations draft review/comments
New business:
1. Gravel Pit site visits scheduled for 9/21/10 at 5P. Site visit notices will be sent out closer to the event.
2. Alternates need to find interested parties to serve as alternates to the Board.
Other business/Public Participation
Open for Public comment at 6:35 p.m.
1. Michael Clough re: property on Rt 3 south, lot with 4 cabins previously part of a subdivision 2006 Rimad LLC/Birch Hill Cottages.
a. Asked about further subdivision minutes from approval date were retrieved, stated no further subdivision would be authorized. States using seasonally.
b. Wondered about increasing ownership on the deed not a Planning Board issue but usually can add who you want on a deed (not a legal opinion)
c. Final signed plat not in the file.
d. Anne-Marie gave him information where to find the minutes online.
e. Final plat will be found.
f. Mr. Clough will come to the next meeting which is 9/13/10.
2. Terry Whipple Woodstock Cycle works Rt 3 south
a. Stated he is concerned about activities on the lot behind him recently purchased. He states he has spoken to the owner.
b. Most of concern surrounds the fact that the land is mostly ledge and blasting would have to occur to gain access and not far from his house.
c. Another concern was that all boundary pins are missing including an abutters pins that had a survey within the past 10 years.
d. It was explained that the Selectmen would have to be notified for any timber permit. The Board referred this issue to the Selectmen as there was nothing in our Subdivision or Excavation Regulations that would be of assistance to him.
3. Anne Gianci Grayhill Condos Rt 3 South at South Station Rd
a. Primary concern was association issues (not a Planning board issue) and question regarding the Gianci Bros. wanting to vote at the association meeting.
b. Property has 8 condos and the subdivision approval is valid for an additional 16 units on the rest of the land owned by the Gianci Bros. at this time.
c. The condo docs have been registered with the Atty. General and the Gianci Bros. own 16/24ths of the parcel.
d. Although not a legal opinion, the Board did not believe that the owner could vote at the Asso. Meetings.
e. Given that these appeared to be association and legal issues, the Board suggested that Ms. Gianci contact an attorney.
4. Patrick Griffin
a. asked if we considered keeping a road bond in place for7 years after a project is completed. The Board is working on revision of the Subdivision regulations now and will keep that in mind.
b. We are now using a Town Engineer for Major subdivisions to conduct a peer review of the site engineer with written reports to the Planning Board.
c. We will be reviewing length of time an approval is valid also.
Projects Ordinances
Shoreland Protection last revised 3/09/93 at Town Meeting States revision needs to occur at Town meeting.
Floodplain Development - last revised 3/14/00 at Town Meeting States revision needs to occur at Town meeting.
